Problem with battery in M5

I am wanting to know if anyone else has seen or heard of this behavior and if there is a known cause.

I bought a spare battery for my M5 on ebay. When I switch to this battery my GPS will start up but acts as if I did a factory reset. My maps, waypoints are gone. The only waypoints I have there are the ones from the factory.

This whole process only takes about 30 secs so the internal backup battery (which is fully charged) should be able to hold the data in the GPS until the new battery is in.

Very strange behavior and pretty much defeats the purpose of having an extra battery, if I was out somewere and had to change the battery and it removed all my maps and waypoints, there is no point.
